As the nation gears up for the midterms next year, many on the Far Left are laying the groundwork to bring back radical “court reform” and the Supreme Court Coup should they regain political power.

The U.S. Attorney General during the Obama Administration, Eric Holder, recently said Democrats must make “court reform” a part of their 2026 party platform, which includes ending life tenure for Supreme Court justices and expanding the Court.

“People shouldn’t be on the Supreme Court for 30, 40 years, and become disconnected from the country that they’re supposed to serve,” Holder shared on a recent podcast. “Eighteen years is enough for anybody to serve on the Supreme Court…And so I think at a minimum, that should be a part of any Democratic Party platform.”

“At a minimum, I think that anybody who tries to run for president should say that I am for or I will try to implement, either by constitutional amendment or if there’s a statutory way to do it…term limits for people who serve on the Supreme Court,” he added.

“If the Democrats win the presidency, the Senate, and the House in 2028…they may have to expand the court to 13 members,” political strategist James Carville said in a recent interview.

“Democrats who are dissatisfied with the past four years of the Supreme Court’s handiwork need to learn from their mistakes—to start building popular support for court reform now, so that they can act decisively if and when they are next in power,” declared Jay Willis, a writer for Slate Magazine. “Democratic politicians need to start laying the groundwork for court reform now, by making the case to voters that the current court poses an existential threat to everything they care about.”

New York Times contributing editor and author of the book The Right of the People: Democracy and the Case for a New American Founding, Osita Nwanevu, said in an interview that the Left-wing critique of the Supreme Court will be an ongoing conversation.

“My expectation is that all of these ideas are going to be part of the political conversation on the Left and are going to be very influential in the next democratic administration,” Nwanevu said.

Within the last few years, the Far Left has aggressively pushed to undermine the constitutional order under the guise of “court reform.” Many claim that the Court is “out of touch” with the country, unbalanced and needs to be fixed.

Court packing and ending life tenure for federal judges aren’t the only dangerous proposals. Some would give Congress the power to oversee the Court’s ethics code and even prevent the Court from hearing certain cases, effectively destroying the power of judicial review.

Radical “court reform” is not likely to happen soon. The prospect that court-packing or other “reform” legislation passes is slim to none. However, that doesn’t mean that those on the Far Left have stopped pushing for it.

Just because the Supreme Court Coup has simmered down for the time being, it doesn’t mean we can let our guard down.

First Liberty is actively working to counter and stop any future attempts at radical “court reform.” Our team is working with the top scholars, professors and legal minds in the nation to ensure that more Americans learn about the dangers of court-packing and other schemes.

In November, First Liberty’s Center for Religion, Culture & Democracy, the James Wilson Institute and Federalist Society are teaming up to host a symposium at the University of Chicago. This will be an in-depth discussion of landmark Supreme Court decisions that have changed the course of America, and how to respond to critics who continue to undermine the Court’s legitimacy.

Fighting for religious freedom is meaningless if the courts are politicized and turned into an extension of whoever holds power. We will do everything we can to protect judicial independence and the integrity of the courts.
