The U.S. Supreme Court could soon decide whether to take up First Liberty’s case involving Blake Warner.
This is a major case that can ensure government doesn’t get in the way of parents deciding what’s best for their children.
Blake lives in Hillsborough County, Florida, where he filed a legal complaint against the school board. However, he was told by a court that he must have an attorney in order to legally represent his child. We asked the Supreme Court to hear the case and to review a lower court ruling, arguing that forcing Blake to get a lawyer infringes on a parent’s right to make critical decisions for his child, and a child’s rights to access the courts and do so without an attorney.
Parents have a right to decide whether a lawyer will represent their child, or whether they will take on that responsibility. That decision is no different from many of the other important decisions parents make in the upbringing of their children—such as choosing a religious school, when they get a driver’s license or what movies they’re allowed to watch. In addition to protecting religious freedom, the Constitution undeniably protects parental rights, which includes the right of parents to choose what’s best for their kids.
