Victory for Jewish Lawyer Fired for Religious Objection to Vaccine

Great news! We’re happy to report a victory for our client, Rachel Spivack.

On Monday, the U.S. Circuit Court of Appeals for the Third Circuit ruled in favor of Rachel, who was fired for refusing to receive the COVID-19 vaccination, because her Orthodox Jewish faith prohibits her from receiving any vaccines.

Rachel Spivack served as an assistant district attorney in Philadelphia District Attorney Lawrence Krasner’s office. When her employer mandated the vaccine, Rachel requested a religious accommodation and waited for almost seven months for a response to her request. She was fired when her request was denied, although other employees were accommodated because of medical reasons and union membership.

The 3rd Circuit reversed a lower court that had ruled in favor of DA Krasner. This week’s ruling held that Rachel is entitled to a trial because Krasner’s decision may have arisen from religious hostility. According to the Court’s opinion, it’ll be up to the jury to decide whether the DA’s actions and statements showed “hostility toward religious viewpoints that influenced the DAO’s treatment of religious exemptions.”

“We are grateful that the Appeals Court recognized that these important issues deserve a jury’s consideration,” said First Liberty Senior Counsel Lea Patterson, who argued the case before the court. “No American should lose her job for living according to her sincerely held religious beliefs.”

This is an important win for our client. But our legal fight for Rachel is not finished.
